Romero Pizza House

The Application

Romero Pizza House, 97 Bond Street Blackpool has the benefit of a premises licence authorising the provision of late night refreshment 23.00 - 00.00 hours daily.

On the 5th December 2013, the Licensing Service received an application to review the premises licence on the grounds of crime and disorder and public safety. A copy of the application is attached at Appendix 4a.

The licence holder is Mr Zeeshan Hussain

Representations in support of the review have been submitted by Lancashire Constabulary attached at Appendix 4b.

National Guidance

Where the licensing authority considers that action under its statutory powers are necessary, it may take the following steps:
1. Modify the conditions of the premises licence
2. Exclude a licensable activity
3. Remove the Designated Premises Supervisor (if licence authorises sale of alcohol)
4. Suspend the licence for a period not exceeding three months
5. Revoke the licence.

Annex 1 - Mandatory conditions

1 In order to avoid unreasonable disturbance to residents of the neighbourhood the opening or keeping open of the refreshment house for public refreshment resort or entertainment between midnight and five of the clock in the morning is prohibited.

PANEL'S REASONS FOR REACHING ITS DECISION

The Panel agreed to proceed in the absence of the Licence Holder on the grounds that the applicant had been properly notified of the hearing.

The Panel considered the evidence submitted by all parties, the Council's Statement of Licensing Policy and the Secretary of State.

The Panel considered that given the severe Health and Safety issues outlined, the only way to ensure the promotion of the Licensing Objective of Public Safety was to revoke the Premises Licence.

That the Premises Licence for Romero Pizza House, 97 Bond Street, be revoked.
